Abstract

This study assessed the role of the independence of the judiciary in promoting good governance in Korogwe District Court in Tanzania. Specifically, the study examined the status of independence of the judiciary, the extent to which the independence of judiciary promotes good governance and the factors affecting the independence of the judiciary in Korogwe District Court. The study employed both quantitative and qualitative research approaches applying a case study research design. A total of forty respondents were selected through purposive and random sampling techniques. Data were gathered through questionnaire and interview. The study found that nearly all respondents were knowledgeable of the independence of the judiciary at the district court level. The observed high knowledge of the independence of the judiciary is attributed to the respondents being the employees of the court. The majority of the respondents, 28(80%) perceived the independence of the judiciary in the district court as moderate. This is linked with ineffective separation of power doctrine. However, a few respondents, 11(33%), believed that the independence of the judiciary contributes to promoting good governance to a lesser extent. On the other hand, the results indicated that the independence of the judiciary in Korogwe District Court is affected by legislative or executive, the parliament and intelligence agencies, political parties’ affiliations, criminal networks and individuals. Ultimately, the study recommends that the judiciary be left free to work independently without interference from other organs in decision-making processes. Further, the Constitution of the United Republic of Tanzania should be adhered to and respected for the sake of freedom, peace and justice in Tanzania.
